the current market is tough and opportunities to be both the listing agent and buyer’s agent can be lucrative with commissions – but they can also be dangerous. the property was held in a trust and only one of the offers had that the trust advisory was to be attached. and it becomes a disadvantage to the buyer where the buyer has the ability to put that in at the first stroke. i think it’d be better for the selling agent to have a conversation with the buyer. the courts can imply every other reasonable term, but those are the three things that have to be in a contract for it to be enforceable.
