we’re always a bit wary when patrons ask for a free or standard power of attorney form. this is not to say you can’t do a little, or a lot, of reading yourself about powers of attorney and on what to expect when talking to a lawyer about preparing a power of attorney. you shouldn’t be able to sleep at night, unless you talk to a real attorney about that power of attorney. keep in mind also that filling out a power of attorney “form” may not be enough to protect your rights, or your family’s rights.

power of attorney is a legal document that gives a person the power to act on another person’s behalf. it is also important to note that the principal can make a current poa durable at any time. a physician will have to declare the principal incapacited, but once they do, the poa is no longer effective. it permits a portfolio manager to invest or move around funds on behalf of the account holder. a minor power of attorney does not use the court system to legitimize it.

advance directive (medical poa & living will) – this is a document that combines a medical power of attorney with a living will, creating an instrument where the principal can stipulate what is to occur should they become incapacitated and who will have the authority to make decisions on their behalf. medical power of attorney – strictly allows a person to choose someone else to act as their health care agent in case the patient is no longer able to make decisions for themselves.

a power of attorney (poa) form is a legal document that lets you appoint someone you trust, called your “agent” or “attorney-in-fact,” to manage your affairs if you’re unable to do so. a durable power of attorney form focuses on how an agent can act on your behalf if you become incapacitated. a medical power of attorney is a type of durable power of attorney that specifically allows an agent to make health care decisions for you if you become incapacitated. on this part of the form, you can also nominate a second person to be your agent if the first is unwilling or unable to fulfill their duties.
