if a third party claims that any portion of the products or services provided by supplier under the terms of the contract or this hosting agreement infringes that party’s patent or copyright, supplier shall defend and indemnify the state of oklahoma and customer against the claim at supplier’s expense and pay all related costs, damages, and attorney’s fees incurred by or assessed to, the state of oklahoma and/or customer.
