service provider shall submit monthly invoices of the service fees due and payable to it under the terms of this agreement. because the services are personal and unique and because service provider may have access to and become acquainted with the confidential information of spml, spml shall have the right to enforce this agreement and any of its provisions by injunction, specific performance or other equitable relief without prejudice to any other rights and remedies that spml may have for a breach of this agreement. for and in consideration of the full and faithful performance and completion of the stipulated work by the service provider in accordance with the terms and conditions agreed upon, spml agrees to pay the service provider a service fee equivalent to the actual cost plus 10% mark up.
