any dispute or claim relating in any way to your use of the service offerings, or to any products or services sold or distributed by usan will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. you may use usan confidential information only in connection with your use of the service offerings as permitted under this agreement. if you are using the service offerings on behalf of the u.s. government and these terms fail to meet the u.s. government’s needs or are inconsistent in any respect with federal law, you will immediately discontinue your use of the service offerings. if any portion of this agreement is held to be invalid or unenforceable, the remaining portions of this agreement will remain in full force and effect. “your content” means content that you or any end user processes, stores or hosts in connection with your usan service offerings and any computational results that you or any end user derive from the foregoing through their use of the service offerings.
in the event of a conflict between this agreement and such separate license, the separate license will prevail with respect to the software included in the software that is subject to such separate license. this agreement is not a sale of the software or any copy thereof and customer has only acquired a license to use the software on the terms set forth herein. all payments made by customer to thinkbox under this agreement will be made free and clear of any withholding or deduction for taxes.
